Who is Tatiana Herrada?

I am Tatiana Herrada, a lawyer specialized in Construction Law, Infrastructure Projects, and the Prevention and Resolution of Disputes. I have expertise in Public Procurement, Public--Private Partnerships (PPPs), FIDIC Contracts, NEC Contracts, and Dispute Boards.

I work as a consultant, arbitrator, and Dispute Adjudication Board (DAB) member in the prevention and resolution of construction disputes.

Construction Law and Dispute Resolution are my passions. And, as passion makes work effortless, I have dedicated myself to continuously studying and training in the areas in which I specialize.

My mission as a consultant, arbitrator, and DAB member is to provide ethical, specialized, efficient, and timely services.

CONSTRUCTION AND INFRASTRUCTURE ARBITRATION

As an arbitrator, I have resolved disputes in over 30 construction arbitration cases, serving as a sole arbitrator, party-appointed arbitrator, and presiding arbitrato.

I believe that the arbitrator should conduct arbitrations with a project management approach, seeking efficiency, order and transparency in the arbitration process, taking care of and respecting the parties' right to due process.

I have prevented and/or resolved disputes arising from different contracting regimes. Here I share with you my specific experience:

PUBLIC WORKS

Projects contracted under the Peruvian State Contracting Law (LCE), involving disputes related to deadline extensions, additional work, increased costs due to inefficiencies, misapplication of penalties, improper enforcement of guarantees, and wrongful termination of contracts.

PUBLIC-PRIVATE PARTNERSHIPS (PPPs) AND CONCESSIONS

I have resolved construction disputes in the contractual relationship between grantor, concessionaire, supervisor and contractors and subcontractors; as well as conflicts related to the operation and maintenance of these infrastructures.

FIDIC CONTRACTS

FIDIC contracts have been used for more than 25 years in Peru, which has allowed me to advise on the formulation of claims and the resolution of disputes arising from the white, red, yellow and silver books, among others.

NEC CONTRACTS

I have resolved construction disputes arising from the execution of NEC contracts in more than 50 cases, through formal assistance proceedings and formal submissions to DAB under ICC regulations.

WORK FOR TAXES (OXL)

A Peruvian project delivery method that allows construction companies to obtain tax benefits in exchange for executing public works. These projects often give rise to typical construction disputes, and I have experience resolving them under this special legal regime.
