I am Tatiana Herrada, an expert lawyer in Construction Law, Arbitrator and DAB.

Construction Law and Dispute Resolution are my passions. I was fortunate to discover this at the beginning of my professional career, and throughout these years I have dedicated myself to study, teach and work in engineering, construction and infrastructure projects on a larger scale, structuring projects, strategically advising during contractual execution, preventing luckyand resolving disputes.

The design of effective strategies, work planning, team management, result orientation and the creation of professional and commercial relationships based on trust and empathy are my added value.

In addition to acting as a consultant, I serve as an arbitrator and adjudicator. I am part of the main registries of arbitrators in Peru: CCL, Amcham and CARC- PUCP. And, at the international level, I have been part of the ICC arbitrator training program.

I founded CDR/Consulting, a consulting firm specialized in Construction Law and Dispute Resolution, which I direct and from where I advise several contracting companies and contractors in infrastructure projects in LATAM with a multidisciplinary approach covering legal, contractual, technical and financial aspects.

CONSTRUCTION AND INFRASTRUCTURE ARBITRATION

As an arbitrator, I have resolved disputes in over 30 construction arbitration cases, serving as a sole arbitrator, party-appointed arbitrator, and presiding arbitrato.

I believe that the arbitrator should conduct arbitrations with a project management approach, seeking efficiency, order and transparency in the arbitration process, taking care of and respecting the parties' right to due process.

I have prevented and/or resolved disputes arising from different contracting regimes. Here I share with you my specific experience:

PUBLIC WORKS

Projects contracted under the Peruvian State Contracting Law (LCE), involving disputes related to deadline extensions, additional work, increased costs due to inefficiencies, misapplication of penalties, improper enforcement of guarantees, and wrongful termination of contracts.

WORK FOR TAXES

Works for Taxes are a Peruvian project delivery modality that allows construction companies to obtain tax benefits through the execution of public works. During the execution of these projects, typical construction disputes arise. I also have experience resolving disputes under this special legal regime.

PUBLIC-PRIVATE PARTNERSHIPS AND CONCESSIONS

I have resolved construction disputes in the contractual relationship between grantor, concessionaire, supervisor and contractors and subcontractors; as well as conflicts related to the operation and maintenance of these infrastructures.

FIDIC

FIDIC contracts have been used for more than 25 years in Peru, which has allowed me to advise on the formulation of claims and the resolution of disputes arising from the white, red, yellow and silver books, among others.

NEC

I have resolved construction disputes arising from the execution of NEC contracts in more than 50 cases, through formal assistance proceedings and formal submissions to DAB under ICC regulations.

EXPERIENCE BY INDUSTRY SECTORS

I have had the opportunity to work in the whole cycle of infrastructure projects, from the definition of the procurement strategy, the codesign of tailor-made contracts and also using international standardized contracts such as FIDIC and NEC, the strategic contract administration, the elaboration and absolution of construction claims, as well as in the prevention of disputes in proceedings before DAB and their resolution through national and international arbitration.
